1. Acceptance of Terms

By downloading, installing, or using the Katiba application ("App") or visiting our website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Site.

2. Description of Service

Katiba is a civic education application that provides access to the text of the Constitution of Kenya (2010), AI-generated summaries of constitutional clauses, interactive learning features, and related educational content. The App is provided free of charge for personal, non-commercial educational use.

3. Use of the App

You agree to use Katiba only for lawful purposes and in accordance with these Terms. You must not:

  • Use the App in any way that violates applicable Kenyan or international law or regulation.
  • Reproduce, distribute, or create derivative works from the App's source code, design, or content without written permission.
  • Attempt to reverse-engineer, decompile, or extract source code from the App.
  • Use automated tools to scrape, crawl, or extract data from the App or Site.
  • Misrepresent AI-generated summaries as official legal interpretation or advice.

4. Constitutional Content

The text of the Constitution of Kenya reproduced in Katiba is a public document. Katiba does not claim ownership of this text. AI-generated summaries are provided for educational purposes and do not constitute legal advice. For authoritative legal interpretation, always consult the official Kenya Law publications or a qualified legal practitioner.

5. Intellectual Property

All original content in Katiba — including the app design, branding, illustrations, custom iconography, and non-constitutional written content — is the intellectual property of Katiba and its contributors, protected under applicable copyright law. You may not use these materials without prior written consent.

6. Disclaimers

Katiba is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content in the App. AI-generated summaries may contain errors or omissions; always cross-reference with the official constitutional text.

7. Limitation of Liability

To the fullest extent permitted by law, Katiba and its contributors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

8. Third-Party Services

The App integrates third-party services including Google Gemini AI and Firebase. Your use of these services through Katiba is subject to their respective terms of service. We are not responsible for the practices of these third parties.

9. Changes to the App and Terms

We reserve the right to modify or discontinue the App at any time without notice. We may also update these Terms periodically. Continued use of the App after any changes constitutes your acceptance of the new Terms. We will always post the current version of these Terms on this page.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Kenya.
